摘要

The establishment of Chinese socialist market economy system and modern enterprise system will inevitably bring Chinese stock market the greater width and development. How to administrate Chinese stockmarket through legal system has become an urgent matter. The author holds that the twofold administrative system by the state and local government has more drawbacks than advantages. The administrative powers over Chinese stock market should be concentrated on the central government,exercised in accordance with law and regulation, in order to*ensure the state's supervision over stock market, just as in America and Japan. The present regulations in Chinese stock market administration exercise slight punishment to the acts harmful to the development of stock market. Besides penalty, the concept of "guilt" and definite sentence provisions should be added as to strengthen the punishment and to ensure the stability of stock market.
机译：中国社会主义市场经济体制和现代企业制度的建立，必然带动中国股票市场的更大范围和发展。如何通过法律制度管理中国股票市场已经成为当务之急。作者认为，国家和地方政府的双重行政体制弊大于利。与美国和日本一样，对中国股票市场的管理权应集中在按照法律和法规执行的中央政府上，以*确保国家对股票市场的监督。中国股票市场管理的现行规定对危害股票市场发展的行为进行了轻微处罚。除处罚外，还应增加“有罪”和定罪条款的概念，以加强处罚并确保股票市场的稳定性。
