Risk in underground infrastructure projects, especially those using trenchless technologies, is different from that in other branches of construction. The assumption that the risk is necessarily greater is wrong. The risk in a project can be minimized through the application of experience and engineering judgment and through acquiring adequate information on conditions likely to give rise to risk. Each risk is best assigned to the party that is best able to manage it cost-effectively. Traditional contract practice in which the owner takes most of the risk does not achieve this. There is a need to change the form of contract to match the advances in technology. However to gain the maximum benefit from such change requires the contracting community to understand that their capabilities and experience can give them a major competitive advantage because they reduce their risk. The lack of recognition of risk and responsibility explains why new technologies are slow to take off. Use of performance contracts could lead to a major increase in work using new technologies as contractors use their skills to provide owners with more cost-effective solutions.
