EPA Air Toxics Regulations for the Metals Industry: A Status Report

The U.S. Environmental Protection Agency (EPA) is implementing a 10-year program to regulate approximately 170 industry categories for hazardous air pollutants The program is complex because the regulations will apply to a wide variety of operations, including smelting, refining, ore and minerals processing, production of intermediate and final shapes, and chemical finishing The program is also new: the National Emission Standards for Hazardous Air Pollutants (NESHAPs) developed under this program are based on technology rather than risk management. To effectively manage the program, the EPA is seeking innovative ways to conduct all phases of its operations, including (1) gathering all relevant information needed to determine the impact of the regulation on the environment and the industry, (2) identifying emission reduction measures based on pollution prevention or source reduction rather than collection and disposal, (3) developing methods for effectively monitoring emissions and compliance, and (4) promulgating regulations that are equitable.rnA critical element in EPA's program is its relationship with the regulated industries. The Agency places high priority on working through industry contacts such as trade associations and companies to acquire the best possible information regarding operations, emissions, and effects of process changes. Industries with which the EPA is working or has worked to develop regulations include iron and steel manufacturing, iron and steel foundries, primary and secondary aluminum production, primary copper smelting, and primary and secondary lead smelting.rnRegulations for the metals industry are at various stages of development. This presentation discusses the status of these NESHAPs along with innovations in program implementation that have evolved in the rulemaking process.
