This article provides general information on effluent trading under the Clean Water Act and is not intended to constitute legal advice. For information or advice on specific compliance or effluent trading issues, you should contact legal counsel.rnThese materials introduce and generally describe the concept of effluent trading, various types of effluent trading, and its potential benefits. U.S. EPA is currently encouraging effluent trading as an alternate method of compliance. Effective use of such a compliance tool requires knowledge of the underlying structure of The Clean Water Act as the context in which trades occur. Accordingly, these materials provide a brief summary of The Clean Water Act's requirements as they apply to direct discharges of pollutants to waters of the United States, and to industrial users which discharge wastewater to publicly owned treatment works under the national pretreatment program. These materials close by reviewing a general framework for developing a trading agreement between two or more entities intending to trade effluent credits or loadings between themselves to more cost-effectively achieve compliance.
