Rapid growth of the animal feeding industry in EPA Region 6 has resulted in increased public concerns associated with improper management and utilization of manure-derived nutrients, such as phosphorus (P) and nitrogen (N). To address these concerns, EPA Region 6 (EPA) has drafted two National Pollutant Discharge Elimination System (NPDES) general permits for concentrated animal feeding operations (CAFO). The two draft permits ― the impaired watershed permit for CAFOs located in nutrient-impaired watersheds and the non-impaired watershed permit for all other CAFOs outside of nutrient-impaired watersheds ― were publicly announced in the Federal Register on June 26, 1998. When finalized, the draft permits will replace the CAFO general permit which expired on March 10, 1998. The proposed impaired watershed general permit is designed to address water quality impacts in nutrient-impaired watersheds by requiring that manure/wastewater be applied at rates based on P requirements of crops. Outside of nutrient-impaired watersheds, the proposed permits require that CAFO operators apply manure/wastewater at rates based on crop requirements of N. However, land application of manure at rates based on N requirements of crops results in a build-up of P in land application fields. Therefore, annual soil sampling would ensure that the concentration of P in land application fields does not exceed threshold levels established by the State/Tribe or the USDA Natural Resources Conservation Service (NRCS). If CAFO operators switched from N-based to P-based manure/wastewater application rates when the P threshold level has been reached in a particular land application area, nutrient runoff into surface water would be abated.
