The Clean Air Act authorizes the United States Environmental Protection Agency ("EPA") to treat Indian Tribes as States for purposes of implementing the Act. On February 12, 1998. EPA promulgated a Final Rule (the "Tribal Authority Rule"), specifying the Clean Air Act provisions for which it is appropriate to treat Indian Tribes in the same manner as States. The Tribal Authority Rule also establishes the requirements Indian Tribes must meet if they choose to seek such treatment and provides for awards of federal financial assistance to Tribes to address air quality problems. This paper discusses the background of the Tribal Authority Rule, the key provisions of the Rule, legal and practical issues raised by the Rule, and the status of litigation challenging the Rule.
