The Health and Safety in Employment Act of New Zealand imposes a duty on all parties to achieve excellence in health and safety management. Principals transfer this duty to contractors through contractual provisions in consideration for a sum of money. However, standard forms of contract and methods of measurements used in New Zealand have failed to meaningfully respond to expectations of the HSE Act: These documents need to be modified to resonate with the Act. A new format for the Preliminaries and General bill is presented categorising health and safety items into two main sections, i.e. "physical arrangements" and "health and safety management" with a detailed list of items with a direct link to the Health and Safety in Employment Act. It is expected that such a bill would negate attempts to price for a "level of safety" par excellence, counter the impact of safety-averse procurement approaches, cope with principals who are not safety conscious, provide opportunities to establish whether adequate sums of money have been provided for safety when evaluating tenders, and also to ensure that what is promised during tender is implemented during construction. Such a list would evoke a safety conscious response from all parties. This would require the Preliminaries and General bill to be re-organised with a specific section on health and safety. It is also expected subcontractors too would be given an opportunity to price using a similarly detailed preliminaries and general bill, especially in medium and large scale projects.
