There is a growing perception that "command and control" regulation ahs begun to reach its limits as an environmental protection strategy. The increasing complexity of today's environmental problems has outpaced traditional regulation. Traditional command controls have been limited by the technology and scientific knowledge available at the time requirements are promulgated. In a number of sectors, industry has taken the initiative and begun to shift toward creative and flexible strategies focused on performance or cost-benefit analysis. The presentation and paper will overview the traditional environmental approach, and provide specific examples of alternative legal and regualtory approaches in the pesticide industries.
