The Impact of the Upcoming Boiler MACT Rules at Three Distilled Spirits Manufacturing Facilities - A Lesson in Strategic Planning

On February 21, 2011, the United States Environmental Protection Agency (USEPA) finalized1 two regulations (40 CFR Part 63 Subpart DDDDD -Major Source Boiler MACT and 40 CFR Part 63 Subpart JJJJJJ - Area Source Boiler MACT) that will have a dramatic effect on reducing emissions of hazardous air pollutants (HAPs) from certain combustion operations located at a wide variety of industrial, commercial and institutional sources. For affected facilities, these rules will also significantly increase the monitoring, recordkeeping and reporting burden for plant personnel. These rules replace the original Boiler MACT rule, which was promulgated in September 2004 and subsequently vacated by the D.C. Circuit Court of Appeals in June 2007, a scant three months before the compliance date for the original rule. In addition, another version of the Boiler MACT rules, proposed on April 29, 2010, was met with such discord from both Congress and industry, that USEPA reduced both the applicability and scope of the final rule. Beam Global Spirits & Wine, Inc. (Beam) operates three distilled spirit manufacturing operations in Kentucky, two of which had already taken steps towards compliance with the original Boiler MACT rule. These two facilities utilize coal, natural gas and propane for combustion operations. The third Beam facility, which was not affected by the original Boiler MACT rule, uses natural gas and fuel oil for its combustion operations. Thus, the differences in fuel use at these facilities and their prior efforts to comply with the original Boiler MACT rule provides a dynamic case study to compare and contrast alternative Boiler MACT compliance strategies. This paper will provide an overview of the three Beam facilities, briefly describe the history of the Boiler MACT rules and examines the potential impact that the February 21, 2011 rules will have on three different distilled spirit manufacturing facilities. In addition, the presentation will discuss the strategic planning process that each facility has undertaken as it heads towards compliance with the Boiler MACT rules.
