Visibility Impacts for Class II Areas - An Assessment of Regulatory Obligations and Best Practices

The additional impact analyses requirement of the Federal PSD Rules [40 CFR 52.21 (o)] is an often overlooked component of PSD applications. The additional impacts language in the PSD rules is very brief and unspecific, especially with respect to the requirement to analyze visibility impacts related to the PSD project. Over the years, regulatory authorities and applicants have addressed the visibility portion of this requirement by assessing project visibility impacts using "plume blight" models such as VISCREEN. However, this approach presents some issues. First, the language in paragraph (o) only states that an analysis should be provided, and does not specify any standards or thresholds with which to assess impacts. The use of models designed for use in Class I areas such as VISCREEN, and the visibility thresholds internal to that model, can mischaracterize the relevance of a project's visibility impact when applied for Class II areas. Second, regulatory authorities and applicants alike are often faced with a decision on where the assessment should be conducted: public lands such as parks and recreational areas are routinely chosen, but should these areas automatically be afforded what amounts to special protection during the PSD permitting process? This paper assesses a source's regulatory obligation to conduct visibility analyses to satisfy the unspecific requirements of paragraph (o). Recommendations are provided, including how to appropriately select an area for analysis and a review of available literature is documented to suggest alternative visibility criteria for plume perceptibility in Class II areas.
