Until recntly, the natural resource damage assessment process following oil spills was conducted behind closed doors. Studies were conducted under the cloak of litigation and the public and response community were often unwaware or unable to reiew the information collected or evaluatge the technical basis for the settlement reched. In some instances, data were kept confidential even aftern the case was closed. In January of 1996b this paradigm was reversed by the new regulations issued by the National Oceanic and Atmospheric Administration under the Oil Pollution Act of 1990 (OPA). These rules outilne a more open assessment process to facilitate both a cooperative assessment effort with the responsible party, and opportunities for meaningful participation in the decision=making process by the public. This paper examines the first test of this new assessment process: the January 1996 spill from the T/B North Cape in Rhode Ishand.~1
