The implementation of Global Mobile Personal Communications by Satellite (GMPCS) highlights asignificant challenge to national sovereignty over telecommunications. The recent GMPCSMemorandum of Understanding, and WTO Basic Telecommunications services Agreement, createnon-binding as well as binding obligations over signatories. This essay will examine in a comparativecontext the emerging policy and regulatory measures adopted by a number of countries in the Asia-Pacific region in the light of commitments made by the said nation states and proffersrecommendations in order to strike a balance between the right of sovereign nations to regulate theirtelecommunications within the framework of their national policies, and the need for GMPCSoperators and service providers to be granted open, fair and competitive access to national marketsunder transparent and non-discriminatory regulatory procedures.
