摘要

Promulgation of the MACT on September 30, 1999 changed the strategic role of the risk assessment in therncombustor permitting process. Under MACT, a somewhat inflexible compliance schedule is prescribed whichrnestablishes a series of benchmark dates culminating in submission of a Notification of Compliance. Although therernare no specific risk requirements under MACT, RCRA omnibus authority still requires that the facility RCRA permitrncontains terms and conditions necessary to protect human health and the environment. This sets up the situationrnwhere a facility could demonstrate MACT compliance and still be subject to risk-based operating limits underrnRCRA. Even more problematic is the MACT schedule. If a facility is going to require modifications/updates to itsrncombustor unit to comply with MACT, that determination will have to be made very early in the process. Thernsame situation exists for the risk assessment; the facility will need to determine if stack emissions are likely to presentrnan unacceptable risk prior to making any capital improvement decisions on modifications/updates to the unit.rnIn contrast to MACT, the risk assessment is still likely to focus on a fairly comprehensive list of both organic andrninorganic constituents, which will probably require the collection of mini-burn data. This paper will present anrnindustry perspective on some of the critical risk assessment issues which could impact the MACT process.
