摘要

In this paper,the author analyzes the internal and external canses of Private enterprises’small number of intellectual property rights applications and lacking protection under the background of the grim protection situation of the intellectual property Hghts of private enterprises in China.The author attempts to prove that renovation of the internal manaRement and the external legal and competing environment is the prerequisite of innovation of private enterprises. Meanwhile,the author analyzes the serious causes of infringement of intellectual property by the opportunity cost.So the author advises that established punitive compensation is an effective way to reduce infringements.
机译：本文在分析我国民营企业知识产权保护严峻形势的背景下，分析了民营企业知识产权申请量少，保护缺乏的内在和外部。内部管理，外部法律和竞争环境的创新是民营企业创新的前提。同时，作者根据机会成本分析了造成知识产权侵权的严重原因。因此，笔者建议确立惩罚性赔偿是减少侵权的有效途径。
