This dissertation explores the conceptualization of sexual violation in early Islamic and classical Maliki legal discourse, as well as the ways in which Islamic legal doctrines reflect cultural ideologies of sexuality, gender and subjectivity. The author conducts her exploration through a textual analysis of primarily two bodies of literature: the prominent Sunni h&dotbelow;adith collections, and the fiqh works of the Maliki jurists through the 6th/12 th century. The author seeks to situate early Islamic doctrines on sexuality and sexual violation within the broader ethico-legal ideologies of the Late Antique Oikumene, and utilizes anthropological and ideology theories to frame her concerns.; The key findings presented in this dissertation are as follows: Sexual violation in Islamic/Maliki legal ideology is articulated in response to broader regional trends. These trends are three: a shift toward an ethical rather than cosmological notion of religion, a shift from proprietary to theocentric approaches toward sexuality, and an increasing emphasis on the individual as an autonomous ethico-legal subject. The Qurano-Prophetic intervention may be interpreted on the whole as a definitive affirmation of theocentric ethics. Islamic legal discourse, from the formative era (i.e. the pre-classical period ending in the mid-2nd/8th century) through the maturation of the schools of law (in approximately the 6th/12 th century), contains a spectrum of responses to this theocentric affirmation. The Maliki school's doctrines on sexual violation, this author argues, represent an attempt to reconcile pre-existing proprietary approaches toward sexuality with the strongly theocentric approach introduced by the Qur'an and the Prophet.
