Exploring Legislative Change Through the Lens of Homeland Security and Emergency Management.

In 2002, Congress passed the Homeland Security Act of 2002, but after the federal, state, and local governmental response to Hurricane Katrina highlighted the ineffectiveness of the legislation, Congress passed the Post-Katrina Emergency Management Reform Act of 2006. The problem that was addressed through this study was the lack of a feedback loop in homeland security and emergency management legislation makes it virtually impossible to determine if the legislation actually accomplished what the legislators intended, and without an evaluation capability, legislative change can be irrelevant. In this study, legislative change theory was used to explain the requisite steps for successful legislation. Accordingly, this qualitative, multiple case study research became a foundational examination of legislative change theory through the lens of homeland security and emergency management. A convenience sample of 16 homeland security and emergency management experts represented state, parish, and local homeland security and emergency management experts with expertise in working to implement federal and state homeland security and emergency management policies. Interview questions aligned with the specific research questions that focused on homeland security collaboration, funding, law enforcement, and fusion center effectiveness examined the challenges faced by the state, parish, and local homeland security and emergency management agencies. The data were coded and synthesized for reportable themes that enabled grouping, coding, and in-depth analysis of the needs of the lower level homeland security and emergency management agencies. Three overarching themes uncovered were homeland security and emergency management: (a) involved all hazards, regardless of origin, (b) must include federal, state, and local governments, as well as the private sector, and (c) a universal, codified definition did not exist. Three recommendations emerging from this study included the need for (a) a common definition for homeland security, (b) give decision-making authority to the command and control element (c) amend federal personnel regulations to require a joint certification for senior promotion eligibility. Recommended future research includes (a) validity of assessment criteria as a means to determine legislation effectiveness, (b) reimbursement definitions used by FEMA, (c) have the mission determine the policy, and (d) updating existing Stafford Act.
