This study was prepared to present a thorough review of the current methods for meeting the defined "All Appropriate Inquiry" standards required under CERCLA to satisfy for one of the Legal Liability Protections (Innocent Landowner, Contiguous Property Owner and Bona Fide Prospective Purchaser) clarified through the new Brownfield Amendments of 2002 and proposed rules by the Environmental Protection Agency.;Additionally, this study evaluated the evolution of the Environmental Site Assessment process through NEPA, RCRA, CERCLA, and ASTM. The study includes a thoughtful review of industry practices concerning Phase I Environmental Site Assessments, Limited Site Investigations (commonly referred to as Phase II ESAs) and the associated options once contamination has been identified at real property.
