This historical study of the impact of the state action doctrine on private higher education accomplished several objectives; provided a general history of the origins of the state action doctrine and the Fourteenth Amendment to the U.S. Constitution; provided a review of some of the more salient cases addressing state action generally; and provided a review of the federal appellate court cases and U.S. Supreme Court cases impacting private higher education. The study noted that the Court filters the question of state action through four tests: the symbiotic relationship test, the public function test, the nexus test, and most recently, the entwinement test. The study concluded that findings of state action were narrowed significantly following the 1982 cases known as the Blum trilogy, but that the recent pronouncement by the Court in Brentwood Academy v. Tennessee Secondary School Athletic Association could allow an expansion of state action which would have an impact on private higher education.
