Traditional threats to organizational success required security measures that typically involved site-level personnel at varying levels of involvement, from coworker observation to armed security guards. Although security mechanisms can be effectively utilized, the most effective form of security is the law. In recent years, the increasing value of technology has altered the business practices; however, security enforcement mechanisms still follow legal principles that are of little relevance in policing external or internal threats to valuable proprietary data, or for that matter, personal consumer information. The information age requires new forms of protection for organizations, yet legal foundations, firmly in place to protect traditional business practices, are alarmingly avoided when it comes to protecting forms of technology in those businesses. So-called Cyber-crime is potentially the most significant threat to organizational success, but with the slow but sure legal process, protection lags behind practice. This study explores the current state of cybersecurity law, evaluating its shortcomings and strengths, as well as the possibility of enforcing those laws.
