The purpose of this study is to analyze the impact of the 1819 Supreme Court decision in The Trustees of Dartmouth College v. William H. Woodward on the founding of American colleges and universities between 1819 and 1839. The data used to assess its impact derived primarily from a comparison of thirty-one institutional charters issued before 1819 and forty charters issued to colleges between 1819 and 1839. This sample, which represents 84.5 percent of the total number of charters granted during this time period to colleges which still survive in 1989, includes fifty-eight private colleges, eleven state colleges, and two so-called semi-state colleges. The analysis of these charters concentrates on identifying methods and patterns of state involvement in higher education; additionally, changes in chartering patterns subsequent to the 1819 decision are identified.;By examining the lengthy and complicated history of this case, and by analyzing numerous institutional characters, the true impact and unmistakable importance of the decision on the evolution of American higher education emerge.;The research presented also addresses such questions as the relationship between colleges and states, the outcomes of the decision for private and public colleges, and the role of the state in higher education. As a means of establishing the framework in which to make such analyses, extensive information is provided concerning the educational environment in early nineteenth-century America, including a review of the educational milieu during the Colonial or pre-1776 period, the Revolutionary period, and the early national period from the late 1770's to 1819. A detailed summary of the Dartmouth College Case establishes the sequence of events and identifies the major political, religious, and social issues surrounding the case. The relationship of the case to contract law further elucidates the issue.
