Recently there has been a growing concern with solar energy and the protection of homeowners' access to sunlight. This study presents an analysis of the recent Japanese experience (between the late 1960's and 1976) in dealing with the externality problem of sunlight obstruction by nearby high-rise buildings. The study examines alternative approaches to the protection of solar access, including voluntary trade, litigation, and regulation as well as the assignment of property rights to sunlight. It presents a discussion--based on the Japanese experience--of some technical aspects of defining solar rights, and also briefly refers to a few examples of solar rights in the United States. One chapter is also devoted to a detailed study of the problem of sunlight obstruction in Japan, describing the nature and history of the sunshine disputes between builders or developers and residents. It examines why and how the problem developed in Japan, and discusses how residents attempted to protect their solar access. This is followed by a discussion of governmental responses to sunshine disputes; it focuses on Japanese municipalities' administrative guidelines which in effect assigned property rights to sunlight.;The Japanese experience demontrates that the assignment of property rights to sunlight is a viable alternative arrangement to secure solar access. The study also suggests that the development of Japanese sunshine rights (nissho-ken) is not only a social response to changes in scarcity, technology and relative prices, but also the political choice between contending demands over the creation of new property rights.;This dissertation also briefly reviews some previous models of the evolution or formation of private property rights, and presents two propositions about governmental responses to contending demands over the restructuring of rights. A brief empirical analysis employing a logit (binary-choice) model seems to support the hypothesis--derived from Downs' well-known proposition--that the larger the size of a community, the more the government tends to favor the concentrated interests of the construction industry more than the diffused interests of residents.
