Objectives: The objective of the study is to determine who has ownership of accessibility rights to patient data in an electronic health record within five countries selected. Once this was determined, one could ascertain the importance of access rights of patient data in regards to patient care.;Methods: For this retrospective study, five countries were selected from all across the world with different healthcare systems, governing structures, and various views regarding the Electronic Health Record system. The countries were chosen to get a diverse coverage about patient data ownership and accessibility from around the world. A thorough literature research was conducted to find the following: 1) who rightfully owns patient data accessibility in the countries selected for the research study and 2) the importance of patient data accessibility when it relates to patient care.;Analysis/Discussion: One of the most important observations made was that the electronic medical record system was not implemented in the selected countries at the same time, and consequently it makes it quite difficult to compare ownership rights of accessing patient data in the context of digital patient records. The research determined that in the United States, Canada, United Kingdom, and Malaysia the patients were able to rightfully own their data. Saudi Arabia was the only country among the five nations researched which stated that those who create the patient data (e.g. healthcare providers) have full ownership to the access of the medical record and the information within it. The quantity and quality of the literature on ownership rights to access patient data did not match the author's expectations, given the importance of who legally has the rights when it comes to accessing patient data.;Conclusions: Based on the retrospective study, it indicates that the general public has very strong privacy concerns regarding how their patient health information must be handled, and the concerns regarding who may have access to their health information outside the patient care setting. This research reveals that current laws and legal practices don't have the sufficient privacy protection for patients when it comes to their health records. As one article had stated "balancing patient privacy protections with advancing data-driven clinical research and care delivery is an ongoing challenge for many healthcare organizations." [56].
