我国古生物化石保护立法起步较晚，从20世纪90年代末期开始，经过十几年的发展，目前我国已经形成了以《古生物化石保护条例》为主的法律体系。对古生物化石的发掘、收藏、流通、进出境、法律责任等重要问题做出了明确规定。然而，在遏制、惩治、杜绝各种破坏古生物化石的违法犯罪行为方面，目前的法律规定显得捉襟见肘。立法上的缺失与漏洞造成了无法可依，因此，进一步完善古生物化石保护立法甚为重要。% The fossil protection litigation in our country is late ,and there have become the fossil protection legal system whose main is the fossil protection ordinance since 1990s .The legal system has regulated important issues about the fossil such as exploration ,collection ,circulation ,entry and exit ,and legal responsibility .However ,the legal provisions are insufficient in suppressing ,punishing and stopping all kinds of Illegal and criminal behaviors for fossils .the deficiency and leak in legislation have resulted in lawless ,so it is very important to improve and perfect the fossil protection legislation .
