矿业权管理是矿产资源管理的核心内容,其制度变迁受多种因素的影响.本文以宏观经济环境为背景,以中央政府、地方政府、企业各利益主体的博弈为基础,系统分析了新中国成立以来,矿业权制度演进的轨迹——矿业权无偿取得的制度安排在计划经济时期长期处于均衡；市场经济体制的建立和完善,使矿产资源有偿使用制度得以确立和不断健全；在有偿使用的基础上,矿业权分类分级管理是各利益主体博弈的结果.在新的宏观经济形势和新一轮利益博弈中,资本与技术如何更好融合,可能是未来矿业权管理制度的演进方向.%The primary concern of mineral resource management is the allocation of mineral rights which institutional changes are bound by the limitations of various factors. Based on macro-economic environment and game of the central government, the local government and the firms, this paper presents a thorough a-nalysis of the changes in China's institutional policies for mineral rights management since the PRC was founded in 1949: institutional free use represents a long-term equilibrium in a planned economy, compensated use policies are established and improved with establishment of socialist market economic system, the classification management of mineral rights from compensated use policies is result of game among many benefit bodies. In new macro-economic situation and next round of interest game, how to deeply integrate capital and technology may be the changing orientation of China s mineral rights management.
