This paper discusses the three kinds of patent strategy of enterprises based on ex-post rewards theory:i) enterprises apply patent after completing a invention in order to get technology monopoly and monopoly profits; ii) enterprises execute ex-post rewards policy to compensate inventions profit due to no patent application;iii) based on applying patent and ex-post rewards,it use the case about China Environmental Project Tech Inc charging HuaYang company and Japan Fuji water corporation infringement to analyze relation and difference between the ex-post rewards policy and patent protection.This paper finally concludes with suitable enterprise patent strategy.%基于后激励理论探讨企业的3类专利战略:①企业完成一项发明创造后申请专利,通过专利来达到技术垄断以获取垄断利润；②通过后激励政策对发明创造因未申请专利而造成的利益损失进行补偿；③申请专利与后激励制度相结合的方式.结合晶源环境工程有限公司控诉华阳电业有限公司与日本富士化水株式会社侵犯其专利的案例具体说明后激励政策与专利保护之间的联系与区别,提炼适合企业的专利战略.
