由于立法的不完善,数据滥用、隐私侵犯等行为对数字经济的纵深发展和政务效能的发挥提出了现实挑战.美国制定了较为完善的法律制度,研究其法律变迁和大数据时代的最新应对,能够为我国政府数据开放的法治化建设提供重要参考.采用文献分析和线上调研的方法深入剖析美国相关法律的制定原因、发布内容和发展趋势,结果表明,完善的立法已经成为规范政府数据开放的重要手段.借鉴美国成熟的立法体系,有助于明确建立我国政府数据开放的责任机制,在维护安全和隐私的基础上充分释放开放数据带来的商业价值,促进政府的善法之治.%Due to the imperfect legislation,data misuse and privacy invasion and other acts has restricted digital economy development and government efficiency.United States has formulated a relatively perfect legal system,study its legal changes and the latest response in big data which is of great reference significance to legalization of our government data open.In-depth analysis of making reasons,published content and development trends of relevant laws Using literature analysis and online research methods,the results show that perfect legislation has become an important means to regulate government data open.It will help to establish accountability mechanism of government data open,and fully release commercial value of data open based on maintaining security and privacy,and promote the good governance of the government if drawing on the mature American legislation system.
