食品安全监管中的部分信息需要免于公开才能实现其价值，这种信息公开例外规则的存在有其正当性基础。理论正当性包含：权力分工、国家职能、权力间对抗与平衡；现实正当性包含：权利主张的困境、统一规则的缺失、历史正当性、国际立法惯例。同时，食品安全监管中信息公开和例外规则还存在着现实和法律两个衔接点。%Some of the information in food safety supervision from the public needs to achieve its value,the information disclosure exception rule has its legitimacy basis. Theoretical justification includes:confrontation and balance of power division,national function,power;realistic legitimacy includes:uniform rules for the plight of the claims,lack of legitimacy,history,international legislation practice. At the same time,the regulation of food safety information disclosure rules and exceptions still exist the realistic and law two points of articulation.
