中国专利质量的提升路径应在技术、法律和市场三维结构认知的基础上,准确把握产业变迁、法律调整和资本作用影响,思考政府保障专利法律质量、促进专利市场价值实现的路径与方法.能够有效提升专利质量的制度设计应在构建保护范围清晰适当、权利稳定可期的高法律品质基础上,补齐专利制度产业化激励短板,构建基于专利制度的流程优化、功能强化和使用增值的系统性思维,强化对专利质量的宏观调控,主动削减专利制度运行冗余、降低实用新型比重,有效支撑国家经济转型和创新发展.%To improve Chinese patent quality, it is important to accurately understand the industrial evolution, legal regulation and capital's influence, on the basis of the knowledge about the three-dimensional structure of technology, law and market; give play to the government's guarantee in promote the quality of patent law and realize the value of patent. System that can effectively enhance the patent quality should be based on high quality patent law that has clear-cut protection scope and provides stable property rights, and at the same time increase the incentive to patent industrialization. It is therefore necessary to cultivate a systematic thought based on process optimization, function enhancement and value-added utilization. The government should also strengthen the macro-control over patent quality and reduce the system redundant, especially the proportion of utility models, so as to effectively support the restructuring of the national economic and innovation development.
