董仲舒的“阳德阴刑”思想

         

摘要

Dong Zhongshu, taking the“three cardinal guides”as the core, discussed that the idea that the king should follow God’s will and laws should be made by the king was reasonable, and he also elaborated the idea that the core of the idea“virtue being prior to punishment”was“virtue as yang and punishment as yin”, that is, virtue as the first and punishment as the supplement. Being carried out in legislation and judicature, it was called trying cases in the spirit of Confucianist classics and carrying out a death sentence in autumn and winter, which formed a set of complete theoretical system. In this way, the orthodox position of Confucianist thought of virtue and punishment was established in more than 2000 years of Chinese feudal society, which laid the foundation for the formation of Chinese legal system.%董仲舒以“三纲”为核心,论述了君承天意、法自君出的合理性,阐述了任德不任刑的思想内核为“阳德阴刑”,即德主刑辅。将其贯彻在立法、司法之中则为“引经决狱,秋冬行刑”,进而形成了一整套完整的理论体系。从而确立儒家德刑思想在中国两千多年的封建社会中的正统地位,为中华法系的形成起了奠基作用。
