The rule of law rooted in whole educational governance process is always the logical funda-mental aim to properly release the liberal space of education and effectively regulate the educational or-der .The significance of legalization of educational governance is to ensure that educational governance is marching toward the field of justice and fairness,to promote the formation of a rational system of educational governance and to expedite the realization of collegiality by multiple subjects.Neverthe-less,in the proceeding of legalization of educational governance,we are facing some practical dilem-mas.The legal system of education is defective and lacking authority;the educational governance structure is fragile and the concept of educational legalization is weak,etc.Reinforcement of legisla-tion,establishment of new structure and exertion of subjective initiative should become the effective ways to accomplish the legalization of educational governance.%法治蕴于教育治理的始终是合理释放教育自由空间与有效规范教育秩序的逻辑旨归。教育治理法治化的价值意涵在于确保教育治理迈向正义公正的场域，促进教育治理理性制度的生成，加快多元主体间共治目标的实现。然而，在推进教育治理法治化进程中也面临着教育法制不健全、缺乏权威性，教育治理结构脆弱，教育法治观念淡薄等现实困境。立法的加强、新结构的构建和主体能动性的发挥应成为实现教育治理法治化的有效路径。
