本文通过整理学界的研究成果，以文献综述的形式出发，梳理家族法的基本理论和历史发展脉络，进而分析家族法的功能和作用，以传统家族法为研究视角，为现今法制建设提供启示。%The author bases the paper on the established studies and elaborates the basic theories and the his-toric development process of the clan’s rules in the form of the literature review.Besides,from the viewpoint of tra-ditional family law,the paper analyzes the functions and uses of the clan’s rules to give insight to nowadays’legisla-tive construction.
