The occurrence of the unjust case concerning Zhang and his nephew demonstrates that there are many de -fects in the criminal procedure in China ,such as lacking principles of statutory procedures ,poor implementation of the principle of presumption of innocence and exclusion rule of illegal evidence ,and imperfect standard of convic-tion,investigation mode and some links in the working mechanism of public security organs .Therefore,on the basis of strengthening relevant legislation ,we should continuously promote the improvement of law enforcement and judi-cial capacity through improving team building and working mechanism so as to guarantee judicial justice and effi -ciency and reduce the occurrence of misjudged criminal cases .%浙江张氏叔侄冤案的发生，表明我国的刑事诉讼程序尚存在程序法定原则阙如、无罪推定原则和非法证据排除规则贯彻不力，定罪标准、侦查模式以及公检法机关工作机制某些环节不够完善等问题。对此，应当在强化相关立法的基础上，通过队伍建设和工作机制的改进，不断促进执法、司法能力的提高，从而保障司法的公正及高效，降低刑事错案的发生。
