The system of the medical technology negligence is not only benefit to the doctors'behavior, but also benefit to solve problems of medical technology negligence in judicial practice. The standard of medical technology negligence is legislated as the law 57 and the law 58 in The People's Republic of China Tort Liability Law. The standard is'the moment level', but what is'the moment level'is not explained. The standard in foreign country is more advance than our country, such as rigorous abstract standard, clinical pathway and medical courts.%医疗技术过失认定标准体系的构建及完善，不仅有利于医护人员对自身诊疗行为的规范，更有利于司法实践中对医疗技术侵权问题纠纷的解决。我国目前的医疗技术过失认定标准是以《中华人民共和国侵权责任法》第五十七、五十八条规定为依据，且以“当时的医疗水平”确定的，但该标准过于笼统、考虑因素不够全面。国外在医疗技术过失认定标准方面较为先进，如设立严谨全面的抽象标准、建立临床路径、设立专业医事法庭等，对于我国医疗技术过失认定标准的建立，具有较强的借鉴意义。
