This paper briefly introduces the nature and characteristics of contracting team,analyzes contradicts existing in contracting team and construction project department,inquires contracting relationship between project department and contracting team in highway construction,and points out matters needing attention in labor contract between project department and contracting team,so as to guide practice.%简要介绍了包工队的性质、特征,针对目前包工队与施工项目部之间存在的矛盾进行了分析,探讨了公路施工中项目部与包工队之间的合同关系,指出了项目部与包工队签订劳动合同的注意事项,以期指导实践。
