企业标准是企业经营权在标准化领域的体现,《标准化法》并没有给企业标准一个正确的定位,对其性质的理解也存在偏差.时值标准化法修改的契机,明确市场经济体制下,企业标准是企业作为独立的主体享有的经营自主权的体现与表达.澄清企业标准法律地位,并以此对《标准化法》的修改与完善,尤其是《标准化法(修订草案)》第2条、14条和22条提出具体的修改建议.%Enterprise standard is the embodiment of enterprise management rights in the field of standardization. The Standardization Law does not give enterprise standard a correct positioning, and the understanding of its nature is also biased. On the occasion of the revision of Standardization Law, this paper makes clear that enterprise standard is the expression of the management rights of enterprise as an independent subject under the market economy system, clarifies the legal status of enterprise standard, and on its basis provides some suggestions to article 2, article 14 and article 22 of the revised draft of the Standardization Law.
