摘要

商标本质上是一种"来源标识",其基本功能是为消费者识别被标识商品的来源提供保障,商标权的设置和保护应当围绕商标的实质和功能进行,商标意义上使用商标标识引人混淆是典型的商标侵权行为,可依《商标法》得到保护.立足于维护市场公平竞争的《反不正当竞争法》,对不正当竞争行为的界定具有模糊性和灵活性,实践中大量存在非商标性使用商标标识等无法依靠商标权保护的情形,应发挥《反不正当竞争法》的补充作用,特别是适用其一般条款,以提供商标法以外的恰当保护.%The nature of trademark is a kind of"source label"whose basic function is to provide protection for the consumer to recognize the source of the labeled commodity. The design and protection of trademark rights should focus on the nature and function of trademark. That using trademark label as trademark brings confu-sion is the typical behavior of infringement of trademark, and the victim can get protection according to Trade-mark Law. Anti-unfair Competition Law, based on protecting the fair market competition, has defined the un-fair competition behavior in an ambiguous and flexible way. There are many situations in which the victim cannot get protection relying on the trademark rights, such as non-trademark use, so it is time for Anti-unfair Competition Law to play the complementary function. Especially its general clause can provide proper protec-tion outside Trademark Law.
