传染性疾病引起的索赔问题极易产生纠纷,纠纷的关键在于传染性疾病是否构成不可抗力.首先,通过对文献梳理分析,识别出解决传染性疾病引起索赔问题的两个关键点即:构成不可抗力的传染性疾病界定、传染性疾病引起索赔的计算.其次,分析了传染性疾病自身和政府采取相关措施的特质描述,并进行了等级划分,将其与不可抗力的"三不"原则进行一一对应,得出了构成不可抗力的传染性疾病的界定.最后,依据13合同范本阐述了传染性疾病引起索赔问题的计算方法.%The claim caused by infectious disease is very easy to cause dispute, and the key of the dispute lies in that whether infectious disease is force majeure. First, through literature analysis, two key points for solving the claim caused by infectious disease are recognized: demarcation of infectious disease that can be regarded as force majeure and calculation of claim caused by infectious disease. Second, the infectious disease and the measures taken by the government are analyzed and graded, and by correspondence with the"three no"principle, the demarcation of claim caused by infectious disease is obtained. Finally, the calculation method for the claim caused by infectious disease is elaborated according to Model Contract 2013.
