FAA’s updated dose/response curve on people’s annoyance with aircraft noise - which shows a far greater effect than FAA had assumed - has the potential to serve as the “new foundation for all legal discussions of noise,” attorney Peter Kirsch of the law firm Kaplan Kirsch & Rockwell, told participants at the recent UC Davis Aviation Noise & Emissions (ANE) Symposium. But, he stressed, “It is a long and winding road and will take a number of years” to determine the legal significance of the results of FAA’s Neighborhood Environmental Survey of the annoyance reaction of residents in communities around a representative sample of 20 U.S. airports, on which the agency’s updated dose/response curve on annoyance is based.
