The focus of the Jan. 11 oral argument in litigation challenging new flight paths out ofWashington Reagan National Airport was on whether there were reasonable grounds for allowing the plaintiffs in the case – citizens associations in the historic Georgetown area ofWashington, DC, and Georgetown University – to have filed their case beyond the 60-day filing deadline imposed by federal law. Judge Harry T. Edwards said he was struggling with the issue of whether FAA was arbitrary and capricious in leaving residents ofWashington, DC, out of the augmented community outreach process the FAA had decided to use to inform communities about the environmental assessment (EA) it had conducted on the new flight paths and denying them the opportunity to “cross examine” the FAA on it.
