摘要

Much of importance has been written about the extent to which signs of convergence may be detected between the U.S. and European approaches to antitrust, and about the remaining areas of divergence. Much also has been written about the desirability, or otherwise, of pursuing greater harmonization of antitrust and of antitrust enforcement internationally. Sometimes the possibility of internationalization is itself seen as a competition between the differing stances taken on each side of the Atlantic as regards the best approach to internationalization and as a competition between the U.S. and the European models of antitrust as to which of them will establish the pattern for the emerging competition law regimes of economies in transition. This article does not seek to address these overarching themes. It hopes instead to describe one particular aspect of the creative interaction between the two major antitrust models. Instead of examining the competition between them, it seeks to describe a specific borrowing by Europeans of some of the elements of the U.S. approach and to speculate upon its systemic impact upon the European antitrust system.
