Predation in the airline industry: the Canadian antitrust approach

The traditional approach to analyzing an allegation of predation in Canada and the U.S., based on a short-run average variable or total cost test and an analysis of the potential for recoupment, has been subject to several criticisms, especially with regard to the airline industry. Partly in response to these criticisms, governments have looked for approaches that will be more likely to identify true predation in this industry, and protect the victims until predation has been successfully prosecuted. The most notable recent attempt to reform the analysis of predation by abandoning the cost-based test, contained in the DOT's proposed guidelines, received numerous criticisms on the grounds that it would chill competition and be impractical if not impossible to implement. These criticisms suggest that a more fruitful direction of reform would involve refining the traditional two-stage approach.
