摘要

The interface of intellectual property (IP) law and antitrust law appears to be a messy place. Since the central goal of antitrust law is to promote competition, monopolizing practices and collusion are condemned under the Sherman Act. Intellectual property law, however, creates legal monopolies―which may become economic monopolies―through patents, copyrights, and trademarks. This apparent inconsistency makes it difficult to articulate a coherent public policy at the interface of IP and antitrust. The struggle to develop a coherent policy has been recognized by the enforcement agencies. At this writing, the Department of Justice and the Federal Trade Commission are holding joint hearings on this very subject.
