Q. I cannot seem to find SAFE Act training for my mortgage loan originators. Isn't training required in order for the Mortgage Loan Originator to register? A. There appears to be confusion regarding the training component of the SAFE (Secure and Fair Enforcement for Mortgage Licensing) Act. SAFE Act training of bank originators is not required by either the act nor the implementing regulation. "The requirements for non-bank, state-licensed originators and banking agency-regulated originators {bank originators) differ. State-licensed originators must be both licensed and registered, while bank originators need only be registered. The SAFE Act and the final rules make it clear that the educational and testing requirements imposed by the SAFE Act for state-licensed originators do not apply to bank originators.
