Environmental law-Statutory protection of environment - Approvals,licences and orders - Species protection-Corporate plaintiff becameowner of vacant lot and carried out environmental assessment - Assessment concluded that there were no tree frogs on property - As result of court order, Minister of Environment and Climate Change re-examined tree frog situation -Minister issued emergency order for protection of frogs, finding that damaging activities on habitat of frogs were ongoing on plaintiffs property - Plaintiff unsuccessfully brought application to rescind emergency order - Plaintiff appealed - Appeal dismissed - To set aside order, plaintiff needed to convince court that it was outside scope of statutory mandate - Provisions under ss. 84(4)(c)(ⅱ)(a) and (b) of Species at Risk Act did not restrict actions to those that were only necessary to address imminent threat - Habitat necessary for recovery of species included its suitable habitat - Majority of plaintiff's lot fell within geographic area provided for in order because it was within suitable habitat established in published scientific studies.
