Aboriginal law-Constitutional issues - Constitution Act, 1982- Duty to consult and accommodate - Company and Minister of Forests, Lands and Natural Resource Operation signed development agreement regarding proposed ski resort on Crown land - First Nation claimed that proposed resort would desecrate sacred area of paramount spiritual importance within claimed traditional territory - Specifically, First Nation asserted that permanent overnight human accommodation would cause Grizzly Bear spirit to leave sacred site - First Nation brought petition for judicial review seeking relief including declaration that agreement violated duty to consult and accommodate under s. 35 of Constitution Act, 1982 - Petition dismissed - Consultation process in respect of First Nation's asserted spiritual right was deep - Noteworthy that First Nation had not challenged regulatory approvals - First Nation first asserted right as primary concern only after 15-year consulation process, which had involved extensive opportunity for First Nation to express concerns about proposed resort - Three years of further discussions and negotiations with First Nation followed before agreement was approved - Record did not disclose cavalier attitude or complete disregard to First Nation's spiritual concerns -Viewed globally, record involved meetings, exchanges and accommodation offers amounting to reasonable process of consultation and accommodation - Accommodations offered included amendments and revisions to proposed resort which fell within range of reasonable responses and satisfied Crown's duty in s. 35 of Act.
