摘要

One of the many benefits of design/build for owners is that there is a single point of responsibility, the design/builder absorbing the legal risks for design defects. In a "bridged" procurement process, however, owners will develop an initial or partial design, use that design in the bid package, and ask prospective bidders to submit proposals to complete the design and construct the project. In this context the question arises whether the risk for design defects should then shift back to the owner. Most of the reported cases addressing this issue have come down in favor of the design/builder, holding that the owner should bear the risk of defects in its own bid documents. In this month's case, however, the design/ builder was unsuccessful in arguing that the owner should be liable for errors and ambiguities in the solicitation drawings.
