There has been a great deal of discussion about the recent cases involving A/E liability under the Americans with Disabilities Act (ADA). Interestingly, similar issues arise in the context of the Federal Housing Act (FHA), which bars discrimination in the sale and rental of housing and contains a specific provision ensuring that certain dwellings are designed and constructed to be accessible to disabled persons.
