摘要

SEPA has issued a consultation on its planned approach to calculating variable monetary penalties, which are likely to come into force from 2017. While SEPA currently has powers to issue fixed monetary penalties of up to £1,000, variable monetary penalties (VMPs) are intended to apply to more serious environment offences and enable SEPA to levy fines of up to £40,000, which is comparable to the level of fines that can be applied by the courts following criminal prosecution. It is intended that the new fines could be levied for both environmental permit transgressions and illegal waste activities operating outwith the regulatory regime.
