Waste operators that fail to comply with environmental or safety law risk incurring financial penalties, which represent uninsurable liabilities for businesses. Back in the April 2014 edition, we considered the sentencing guidelines for environmental offences, which became effective for sentencing offences on or after 1 July 2014. These guidelines have been an important development and generally well received - providing businesses with helpful clarity on levels of fines and promoting a consistent approach. Hot on the tail of the sentencing guidelines for environmenta1 offences, the Sentencing Council has now issued a consultation on sentencing guidelines for health and safety offences, corporate manslaughter and food safety and hygiene offences.
