The latest update to the Regulations came into force in September last year and required businesses to apply the waste management hierarchy to their treatment of waste and saw the introduction of an obligation on businesses that carry waste on their own account to register as waste carriers. Businesses that produce, handle or deal with waste in any capacity are required to use all possible measures to apply the waste hierarchy - prevention, re-use, recycling, recovery and disposal. It IS NOT a criminal offence to fail to do so, but the Environment Agency does have sanctions, including issuing compliance notices (stating the action that must be taken) and stop notices (which prohibit someone from carrying out an activity until the process outlined to remedy the contravention have been taken). Failure to comply with these notices IS a criminal offence. If the notice concerns a failure to apply the waste management hierarchy, the maximum penalty is a ￡5000 fine in a magistrates court, and an unlimited fine in a Crown Court.
